Terms of Service

1. About these terms

These Terms of Service (the "Terms") govern your access to and use of AUSTRANO, a vessel-management platform provided by Self Capsule ("we", "us" or "our"), based in Australia. By creating an account or using the service, you agree to be bound by these Terms. If you are using AUSTRANO on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation.

2. The service

AUSTRANO helps you manage your own vessels. Depending on your subscription, the service includes vessel records, maintenance and work orders, compliance and certificate tracking, team and crew management with role-based access, usage and reservation scheduling, document and photo storage, and email notifications.

We may add, change or remove features over time to improve the service. We will not make changes that materially reduce the core functionality of a paid subscription during a billing period without notice.

3. Accounts and access

To use AUSTRANO you must create an account using an email address and password, or by signing in with Google. You must verify your email address before your account is activated. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

Users belong to organisations and are assigned roles (for example, owner, manager or crew) that determine what they can see and do. Organisation owners and managers can invite other members and are responsible for managing access within their organisation. You must provide accurate and current information when creating and maintaining your account.

4. Subscriptions and billing

AUSTRANO is offered with a free trial, after which continued use requires a paid subscription. Subscription fees, billing cycles and any applicable taxes are shown at the time you subscribe.

Payments are processed by Stripe, our third-party payment provider. We never store your full card numbers. By subscribing, you authorise us and Stripe to charge your chosen payment method for the applicable fees. Unless required by law or stated otherwise, fees are non-refundable.

5. Your content and data

You own the content and data you upload to AUSTRANO, including vessel records, documents and photos. You grant Self Capsule a licence to host, store, process and display that content solely to provide and support the service to you and your organisation.

You are responsible for ensuring that you have the right to upload the content you provide and that it does not infringe the rights of others or breach any applicable law. If you delete your account, we will remove your data within a reasonable period, except where we are required to retain it for legal or regulatory reasons.

6. Acceptable use

When using AUSTRANO, you agree that you will not:

• use the service for any unlawful, fraudulent or harmful purpose;
• interfere with, disrupt, or attempt to gain unauthorised access to the service, its systems or other users' accounts;
• reverse engineer, decompile, or attempt to extract the source code of the service, except to the extent this restriction is prohibited by law;
• upload malicious code or content, or misuse the service in a way that degrades performance or security for others; or
• provide false, misleading or inaccurate information.

7. Termination

You may stop using AUSTRANO and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the service or other users. Where practicable, we will give you notice before doing so. On termination, your right to use the service ends, and we will handle any remaining data in accordance with our Privacy Policy.

8. Warranties and consumer guarantees

To the extent permitted by law, AUSTRANO is provided on an "as is" and "as available" basis without warranties of any kind. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for a failure to comply with a non-excludable guarantee can be limited, it is limited to resupplying the service or paying the cost of having it resupplied.

9. Limitation of liability

Subject to the Australian Consumer Law and any other rights that cannot lawfully be excluded, and to the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the service or these Terms is limited to the amount of fees you paid to us for the service in the twelve (12) months immediately before the event giving rise to the liability. To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss.

10. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notice before they take effect. Your continued use of AUSTRANO after the changes take effect means you accept the updated Terms.
